Section 49
Crime and punishment
(1) If a prisoner commits the following offence, he shall be punished as follows:- (a) If he commits the following offence, he shall be punished with imprisonment for a term which may extend to ten years or with a fine which may extend to one lakh rupees or with both:-
(1) If any wall, window or door of a prison is breached, broken down, destroyed or used, or if any means of secret escape from the prison is made or used,
(2) In case of rioting within the prison,
(3) If the body of a prisoner, prison office employee or visitor is taken hostage, assaulted or tortured,
(4) If arson is committed or caused with intent to destroy any structure or object within the prison,
(5) If the security personnel employed for the security of prisons and prisoners are disarmed or taken into custody.
(b) escape from prison or attempt to escape, with imprisonment for a term which may extend to five years or with fine which may extend to fifty thousand rupees or with both,
(c) A person who has been sentenced in accordance with the prevailing law and is in an open prison, reformatory, rehabilitation center, juvenile reformatory, probation or parole escapes with imprisonment for up to five years or a fine of up to fifty thousand rupees or both,
(d) Imprisonment for a term which may extend to three years or a fine which may extend to thirty thousand rupees or both if he commits the following offence:-
(1) On any person any. If force is used with criminal intent,
(2) Willfully damages or destroys any prison property,
(3) destroys, defaces or tears up the prison records or any missile or document,
(4) Permission. If opened or broken without handcuffs,
(5)/ If any prohibited thing or article is taken, kept or sent within the prison,
(6) If damage is caused by using any article or weapon in a factory or kitchen,
(7) If any CCTV, metallic detector or other equipment kept in the jail is destroyed or misused.
(e) Imprisonment for a term which may extend to two years or with fine which may extend to twenty thousand rupees or with both if he commits any of the following offences:- (1) If he uses insulting or threatening language against any person,
(2) Indecent or undisciplined act,
(3) Repeal of this Act or the rules made under this Act. Any aIf you talk or do it.
(f) If anyone commits an offense related to sexual abuse against a prisoner, the punishment according to the prevailing law shall be imprisonment for an additional period of two years or a fine of up to twenty thousand rupees or both.
(2) Whoever drives away or engages in the driving away of any prisoner shall be punished with imprisonment for a term which may extend to three years or with fine which may extend to thirty thousand rupees or with both.
(3) If any employee or security personnel knowingly or negligently allows the work under sub-section -(1).
(4) Section 37. If the prisoner released on bail according to sub-section (2) does not appear in the jail during that period, the person taking such bail shall be punished with imprisonment up to one year or a fine of up to ten thousand rupees or both.
